From 21 December 2001 The New Privacy Act regulations will protect individuals against any abusive usage of their personal information by organisations. To this purpose, it regulates their collection, storage and disclosure. Organisations must now take reasonable steps to make individuals aware that it is collecting personal information about them, the purposes for which it is collecting the information, and who it might pass the information on to. There are some restrictions on the uses an organisation can make of personal information and on when an organisation can disclose personal information or can transfer it overseas. Except for some special circumstances, individuals have a right to get access to personal information an organisation holds about them and to have the information corrected or annotated if the information is incorrect, out-of-date or incomplete.
Woodley Motor Group Pty Ltd is bound by the National Privacy Principles.
Information we collect includes;
Personal information that is necessary, such as pay slips to support a client's income statement for a finance application.
In addition we will collect this directly from an individual if it is reasonable and practicable to do so.
Personal Information
It can include but is not limited to, the following:
· Name and address
· Date of birth
· Telephone number
· Contents of a file note
· Health Information
· Proposal/Claim forms
· Pay slips/earnings
· Medical Report
· Investigation reports
· Sensitive information. (We generally do not seek to collect sensitive information. We would only do so with your consent, or if required by law or if necessary in connection with a legal or equitable claim).
Primary and Secondary purposes
Your personal information collected by your salesperson is confidential. We will advise you of the purpose of collection.
We collect this information to:
a) To check your identity;
b) To provide you with services you have requested;
c) To inform you of goods and services we think you might be interested in;
d) To set up an account and bill you for goods and services.
We collect this information:

i. When you submit an Application Form to apply for a product or service; ii. Each time we have contacted you through our direct marketing surveys or in response to our direct mail; iii. When you contact us regarding a product or service. |

Sometimes we may be asked to collect particular information about you. Unless we have already done so, when or before we collect that information, we will take reasonable steps to inform you of: i. The purposes for which the information is collected; ii. Where applicable, any law requiring the information to be collected; and iii. The main consequences if all or part of the information is not provided. |
How is Information Used and disclosed generally?

Sometimes we ask you to consent to a disclosure or use of your personal information for a particular purpose. We may do so in writing, over the phone or on our web site. |

Other times your consent will be taken to be given where you indicate to us that you wish to obtain information about any goods or services. We also may disclose or use your personal information without your consent in the following circumstances: i. For a reasonably expected purpose which is related for the purposes for collecting the information is contemplated by this Privacy Policy Statement; or ii. We reasonable believe it is reasonably necessary to assist in enforcing a body to perform its function; or iii. We suspect that an unlawful activity has been, is being or may be engaged in personal information is a necessary part of our investigation or reporting of the matter; or iv. We reasonably believe it is necessary to prevent a threat to life, health and safety; v. We are authorized and required by law to do so - eg where information is required by bodies regulating us on response to Subpoenas or Warrants; or vi. We have contracted an external organisation to provide support services and that organisation has agreed to conform to our Policy standards and to allow us to audit them for compliance; or vii. The disclosure is to a credit reporting agency in connection with us extending credit to you or recovering from you amounts that you owe under any contract which you may have with us. |
We do not disclose your personal information to others except in the following cases:
a) We share information with vehicle manufacturers for administration of the warranty program, as required by Law.
b) We share information with your credit provider if we are arranging finance on your behalf. However we will ask for your written consent beforehand.
c) To our related companies.
d) Where required by law;
e) To organisations which have requested us to provide services to you or who co-operate with us in offering products or services.
You may elect at any time not to have any further communication with us other than warranty related issues and customer satisfaction measures.
However, to effectively establish a relationship and offer you support and assistance we need to provide for ongoing communications. This could include:
· Offer discounts.
· Advising you of a change of address.
· Marketing new vehicle releases.
· Customer loyalty reward programs.

We will take reasonable steps to ensure that your personal information held by us, is protected from unauthorized use, access, modification and disclosure.
How will we inform our customers of our Policies on Information Collection and Use?
The legislation requires that we advise the customer of:
· What information we are collecting (even if we collect it from someone else) - such as name, address, financial information, health information etc.
· Why we are collecting it (for what purpose).
· Who else we may give the information to
· Their rights in relation to accessing the information
· Their right to ensure the information we collect is accurate, up to date and complete.
· Their right to complain if they believe their privacy has been breached.
How do we handle requests for access to, and correction of, information?
An individual has a right of access to most of the personal information that an organisation holds about them. Customers do not have to provide reasons as to why they wish to access their information.
There are circumstances under which we are legally entitled under the Act not to provide a person with access to information. They are in situations where full access would:
· Pose a serious threat to life, health or safety;
· Impact the privacy of another individual;
· Prejudice legal dispute resolution proceedings or negotiations;
· Be unlawful (e.g. disclose confidential information);
· Prejudice fraud or other investigation into unlawful activity;
· Prejudice the activities of a law enforcement body (e.g. taxation department, police department);
· Pose a threat to National Security;
· Frivolous requests made for amusement sake or because of an unrelated grievance).
· Reveal commercially sensitive evaluative information.
Our obligation is to correct any information that is inaccurate, incomplete or not up-to-date, as advised by the customer.
How will we identify a customer's file?
We will not use a Commonwealth Government identifier to identify your records.
We will use our own identifier to organise all information held on an individual.
We are unable to de identify your information as we are required by law to keep Police records.
Can individuals deal with us anonymously?
Our website can be accessed anonymously.
If you are making an enquiry or requesting a quote on a product or service, then you are entitled to withhold your name.
You cannot purchase a vehicle anonymously as we are required to keep Police records.
Managing information across countries?
We are a Private company registered in Australia. Our ACN number is 92 090 535 925.
What are the Guidelines for Sensitive information?
The Privacy Act says that certain personal information is defined as "sensitive" information. Sensitive information may only be collected with consent, or where required by law or for legal proceedings.
Sensitive information may also include information regarding:
· Racial or ethnic origin
· Political opinion
· Sexual preference.
· Membership of a political or trade association or union.
· Political or religious beliefs
· Health information
· Criminal history.
We generally do not seek to collect sensitive information. We would only do so with your consent, or of required by law or if necessary in connection with a legal or equitable claim.
